Based on the findings of an on-site unannounced State relicensure survey completed 8/18/2023, Home Helpers Location #57964 was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

Based on the findings of an onsite unannounced state relicensure survey completed 8/18/2023, Home Helpers Location #57964 was found not to be in compliance with the following requirement of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

(a) The consumer of home care services provided by a home care agency or through a home care registry shall have the following rights: (1) To be involved in the service planning process and to receive services with reasonable accommodation of individual needs and preferences, except where the health and safety of the direct care worker is at risk. (2) To receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services. Less than 10 days advance written notice may be provided in the event the consumer has failed to pay for services, despite notice, and the consumer is more than 14 days in arrears, or if the health and welfare of the direct care worker is at risk.

Observations:


Based on a review of the agency consumer records (CR) and staff (EMP) interview, the agency failed to involve the consumer in the change of service and individual needs and preferences for four (4) of nine (9) CR's reviewed (CR1, CR3, CR4 and CR7).

Findings included:

Review of the agencies consumer admission packet was conducted on 8/17/2023 at approximately 10:40 AM. "CONSUMER SERVICE AGREEMENT...Services(s) will be provided on the following schedule: DAY, TIME OF SERVICE, SERVICE(S) PROVIDED [Monday through Sunday listed] " This schedule is subject to verbal changes. The effective date of the service(s) is: B. SERVICES: The consumer will be included in all service planning. The Home Care Aide will provide home care service(s) requested by, and agreed to by the consumer, Responsible Party and (Agency) Representative.

A review of CR1 on 8/17/2023 at approximately 1:50 PM, start of services 2/23/2021 revealed, A form labeled "CONSUMER SERVICE AGREEMENT...Services(s) will be provided on the following schedule: DAY, TIME OF SERVICE, SERVICE(S) PROVIDED Monday, Wednesday, Friday 2P-4P..." A review of the client's schedule for the month of July 2023 was conducted. Services were provided on the scheduled days. Two of the eleven days services were provided for the month of July 2023 matched the service agreement or agree upon times. Nine out of eleven day for July 2023 did not match the service agreement schedule. The surveyor could not confirm the change in times were review with the consumer/representative or agreed upon by the consumer/representative.

A review of CR3 on 8/17/2023 at approximately 1:50 PM, start of services 4/11/2022 revealed, A form labeled "CONSUMER SERVICE AGREEMENT...Services(s) will be provided on the following schedule: DAY, TIME OF SERVICE, SERVICE(S) PROVIDED Monday, Wednesday, Friday 1P-2:30 P..." A review of the client's schedule for the month of July 2023 was conducted. Services were not provided on the following scheduled days: 7/7/2023 and 7/21/2023. The times services were provided during the month of July 2023 did not match the service agreement schedule. The surveyor could not confirm the change in schedule or times was review or agreed upon with the consumer/representative.

A review of CR4 on 8/17/2023 at approximately 2:15 PM, start of services 3/10/2023 revealed, A form labeled "CONSUMER SERVICE AGREEMENT...Services(s) will be provided on the following schedule: DAY, TIME OF SERVICE, SERVICE(S) PROVIDED Wednesday, Thursday 1:30 -3:30 P..." A review of the client's schedule for the month of July 2023 was conducted. Services were provided on Mondays and Thursdays from 12:15 PM to 2:15 PM. The times and days services were provided during the month of July 2023 did not match the service agreement schedule. The surveyor could not confirm the change in schedule or times was review or agreed upon with the consumer/representative.

A review of CR4 on 8/17/2023 at approximately 2:30 PM, start of services 3/16/2023 revealed, A form labeled "CONSUMER SERVICE AGREEMENT...Services(s) will be provided on the following schedule: DAY, TIME OF SERVICE, SERVICE(S) PROVIDED Friday 11:30..." A review of the client's schedule for the month of April 2023 was conducted. Services were provided on Mondays, Wednesdays and Fridays. The times services were provided during the month of April 2023 did not match for the dates of 4/7/2023 and 4/14/2023. The surveyor could not confirm the change in schedule or times was review or agreed upon with the consumer/representative.

An interview was conducted with the administrator on 8/17/2023 at approximately 3:00 PM which confirmed the above findings.













Plan of Correction:

All consumers/representatives have 24/7 access to see their upcoming schedule via the WellSky Family portal.(scheduling software) All consumers/representatives have 24/7 access to CareSmart Solutions administrative staff to ask any questions or voice concerns and wants regarding their schedule.

During each 90 day assessment CareSmart Solutions administrative staff will review the general hours and times of the scheduled shifts to ensure each consumers needs and preferences are accommodated. CareSmart Solutions will review each consumers/representatives schedules during the 90 day assessment and be completed no later than October 16, 2023.

Based on the findings of an on-site unannounced State relicense survey completed 8/18/2023, Home Helpers Location #57964 was found to be in compliance with the requirements of 35 P.S. 448.809 (b).
